In looking at capital punishment, the Supreme Court concluded in the 1972 case of Furman v. Georgia that the imposition of the death penalty in some cases constitutes cruel and unusual punishment. In this case, William Furman was sentenced to death. He tripped and fell while fleeing a burglary causing his gun to fire killing the resident of the home.
